A La Center man who shot his adult son during an altercation in 2013 was sentenced Tuesday to three months in jail.
Barry D. Breimon Sr., 68, previously pleaded guilty in Clark County Superior Court to attempted second-degree assault in connection with the Oct. 27, 2013, shooting. Breimon initially faced an attempted murder charge, however, that was downgraded as part of a heavily negotiated plea deal, attorneys said Tuesday.
According to a probable cause affidavit, Breimon and his two sons, Barry Breimon Jr. and Kevin Breimon, started arguing after an evening of drinking alcohol at the elder man’s house at 38011 N.E. 109th Ave. Kevin Breimon had left the house when he heard a gunshot. He told police that he went back inside and saw his father holding a pistol and his brother lying on the ground, bleeding. He said his father also threatened to shoot him. He ran and hid nearby, the affidavit said.
Breimon Jr. suffered a gunshot wound to his left hip and right buttocks.
Deputy Prosecutor Mike Vaughn said Tuesday that the case did not go to trial because there were some evidentiary and credibility issues.
Breimon Sr.’s defense attorney, Steve Thayer, said his client had acted in self-defense.
“It’s been quite an ordeal,” Breimon Sr. said of the incident. “In my mind, I thought I was going to get hurt really bad.”
Judge Scott Collier agreed to follow the attorneys’ agreed-upon recommendation of 90 days in jail. Breimon Sr. was given credit for three days in jail. He was taken into custody following the hearing.
